NautiQuiz terms of use

In short: NautiQuiz is a free, unofficial app to practice for the Italian boating license quizzes. It is not affiliated with the Ministry or any other public body, it does not guarantee that you will pass the exam, and for the exam the official regulations always prevail.
1. Scope
These terms govern the use of the NautiQuiz app (the "App"), developed and published by 123studio.dev ("we" or "us"). The App is free and is meant for practicing the theory quizzes of the Italian boating license exam, with exam simulations, practice by topic, review of mistakes, favorites and statistics.
By downloading or using the App you accept these terms. If you do not accept them, do not use the App.
2. Unofficial app
The App is an independent project. It is not affiliated with, endorsed or sponsored by the Italian Ministry of Infrastructure and Transport (Ministero delle Infrastrutture e dei Trasporti), the Italian Coast Guard (Corpo delle Capitanerie di porto โ Guardia Costiera) or any other public body, and it does not provide any public service. It does not replace boating school courses or official materials.
3. Source of the content
The questions come from the official national list of questions for Italian boating licenses, published by the Ministry of Infrastructure and Transport as Annex A to Executive Decree (Decreto Dirigenziale) no. 131 of May 31, 2022, available on the Ministry's website. These are texts of official acts, which are excluded from copyright protection under Article 5 of Italian Law no. 633/1941.
Although we take the utmost care, the content may contain transcription errors or be out of date if the Ministry changes the list or the exam rules. For the exam, only the regulations in force and the documents published by the competent authorities are authoritative: we encourage you to check them against the official sources.

4. No warranty
The App is provided free of charge and "as is". We do not guarantee that the content is complete, accurate or up to date, that the App will always be available and error-free, or that using it will lead to passing the exam. The simulations reproduce the exam format for practice purposes and have no official value.
5. Limitation of liability
To the extent permitted by law, we are not liable for damages arising from the use of the App or the inability to use it, including failing the exam, or for the loss of data stored on the device.
Nothing in these terms excludes or limits our liability where the law does not allow it, such as in cases of willful misconduct or gross negligence, nor the rights that the law grants to consumers on a mandatory basis.
6. Permitted use
You may use the App for personal use and for study. You may not:
- copy, modify, redistribute or resell the App or its protected parts, such as the code, graphics and icon;
- decompile the App or attempt to circumvent how it works, except where the law allows it;
- present the App or its content as official or connected to public bodies.
7. Intellectual property
The NautiQuiz name, icon, graphics and code of the App belong to 123studio.dev. This excludes the official question texts referred to in section 3 and the open source components, which are distributed under their respective licenses and can be viewed in the App under Impostazioni > Informazioni > Licenze open source (Settings > About > Open source licenses).
8. Privacy
The App does not collect personal data. Details are in the privacy policy.
9. Distribution store
If you download the App from Google Play, the Google Play Terms of Service also apply to downloads, updates and your relationship with the store.
10. Changes to the App and to these terms
We may update, modify or discontinue the App at any time. We may also update these terms: the version in force is always the one published on this page, with its last updated date.
11. Governing law
These terms are governed by Italian law. If you are a consumer, the mandatory rules that protect you remain unaffected, including those on the competent court of your place of residence.
